The parties to the Contract, hereinafter referred to as the Lessor – Rudolf Moto d.o.o. and the Lessee, undertake and agree to be bound by and to comply with the content of the General Terms and Conditions when renting a motorhome. Upon confirmation of the reservation, the Lessee is deemed to have read, understood and fully accepted the General Terms and Conditions. The Lessee undertakes to use the vehicle with due care during the rental period and not to intentionally damage or expose it to any hazards.
1. RENTAL TERMS AND CONDITIONS
The motorhome can be rented by a person who:
• presents an identification document with a photograph,
• is over the age of 23, and
• holds a valid driving licence for at least 3 years for category "B" vehicles.
2. RESERVATION OF RENTAL PERIOD AND PAYMENT DEADLINE
After confirming the rental period, the Lessor shall send the Lessee an invoice with a validity of 3 days. The Lessee undertakes to pay 300 EUR upon receipt of the invoice. Payment of this amount confirms the reservation.
The remaining balance is due 30 days before the planned date of collection of the vehicle. In case the reservation is confirmed less than 30 days before the collection of the vehicle, the total amount of the rental must be paid into the Lessor's transaction account within 3 working days.
If the balance is not paid within the above deadlines, the reservation will be deemed to have been cancelled by the Lessee.
3. CANCELLATION OF RESERVATION AND FORCE MAJEURE
Cancellation policy:
If the Lessee cancels the reservation before the start of the rental - cancellation fees will apply according to the date of cancellation. The Lessee will receive a part of the payment (depending on the cancellation date as stated) or issue a credit note for the amount already deposited, which is valid for 1 year.
The Lessee can transfer his/her reservation to another person.
If the Lessee terminates the rental earlier than agreed in the Contract, the Lessor is not obliged to refund the Lessee for the remaining days of the rental period.
The parties hereby agree that if the Lessee breaches any of the provisions of the Contract, the Lessor may immediately collect the vehicle. In such case, the Lessee waives any claims arising therefrom.
In the event of force majeure which includes natural disasters, government prohibitions, epidemics, etc. preventing the rental of the vehicle, the Lessor shall reimburse the amount paid in the form of a voucher valid for 2 years.
In the event of a damaged or undriveable motorhome due to an accident or breakdown caused by the previous lessee, the Lessor may provide the Lessee with an equivalent vehicle or one of a higher price class at no extra charge, or the parties may agree on an alternative rental date, or the full amount paid shall be refunded to the Lessee.
4. CONTRACTED PRICE
The contract price includes rental price, fiscal costs and transport costs, if any.
4.1. The rental price is calculated according to the current price list published on the website and depends on the type of vehicle and the rental period.
Price includes:
- renting a vehicle for an agreed period of time,
- VAT,
- compulsory and Casco insurance
-350 km/day, the excess will be charged upon return of the vehicle at the rate of 0.3 EUR/km,
- basic equipment: water hose, electricity cable, extension cord, stabilisers, gas key, waste water discharge key. 4.2. Each rental is also subject to fixed costs for preparation, handover and collection of the vehicle on site, WC chemicals, 1 cylinder of gas, Slovenian vignette and a final cleaning fee amounting to 120 EUR.
4.3. In the event that the chosen collection and handover location is not at the company's headquarters, the Lessee will also be charged for transport to and from the location according to the published price list on the website.
4.4. If the party requires additional equipment, it will be charged according to the price list published on the website.
Price does not include:
- fuel,
- toll,
- traffic offences incurred during the rental period.
5. RENTAL SECURITY DEPOSIT
The rental security deposit for all rented vehicles is set at 1000 EUR. It must be paid into the Lessor's business account before collection of the vehicle or by credit card at the time of handover.
The rental security deposit is intended to cover any costs that may arise during the rental period, such as:
- 5% deductible franchise and loss of bonus for Casco and basic insurance in case of accident or theft of the vehicle. If the Lessee is involved in several damage events, he/she is obliged to pay the Lessor the deductible franchise for each damage event separately, regardless of fault. In the event that in any proceedings it is proved that the Lessee is not liable for the damage event and the other party or the Lessee's insurer reimburse the Lessor for the full amount of the damage, the Lessee shall be entitled to reimbursement of the amount of the deductible franchise.
- minor damage to the vehicle (up to the full amount of the deposit),
- missing or damaged internal and additional equipment,
- damage not covered by Casco insurance (brakes, glass, tyres, mirrors, etc.),
- damage to the engine or brakes discovered within 48 hours after the end of the rental period,
- late payment fees for failure to return the motorhome on time
- smoking in the vehicle, and
- other breaches of the Contract and these General Terms and Conditions.
5.1. The full amount of the rental security deposit shall be refunded to the Lessee if the vehicle is returned on time, undamaged and in good condition in accordance with these General Terms and Conditions, failing which the rental security deposit shall be forfeited and a written notice of the estimated amount of damage sent to the Lessee within 30 working days.
The rental security deposit is refundable within thirty (30) working days after the return of the motorhome, provided that the amount has been transferred to the Lessor's transaction account.
6. VEHICLE COLLECTION AND RETURN
Vehicle collection:
The Lessor undertakes to deliver to the Lessee the motorhome cleaned, with a full tank of fuel, a cylinder filled with gas and related essential equipment specified in the Contract or these Terms and Conditions as well as additional equipment, if this has been previously agreed and settled.
The vehicle must be collected on the day of rental between 14:00 and 18:00, or by arrangement after 18:00, but no later than 20:00.
In the event of collection between 8:00 and 14:00, the Lessee agrees to pay an additional 50% of the value of the rental day.
The Lessee is obliged to communicate the exact time of collection of the vehicle at least 7 days before the start of the rental period, which must be adhered to by both the Lessee and the Lessor. Subsequent changes are possible and will incur an administrative fee of 60 EUR.
At the time of collection, the parties shall inspect the entire motorhome. They shall check the functioning of the equipment and sign a handover report which is an integral part of the rental contract. The handover report shall include all possible deficiencies, missing equipment, damage to the motorhome, as well as photographs documenting any such damage. The photographs shall be kept by both parties until the rental deposit has been returned or the amount of the damage and the person responsible for the damage has been determined. If the Lessee fails to store the photographs, he/she cannot object to the authenticity of the Lessor's photographs.
The Lessee undertakes to return the vehicle to the agreed location at the agreed time.
Upon return, the vehicle must have:
- an empty waste and clean water tank,
- a full tank of fuel,
- an empty cassette and a clean toilet bowl,
- roughly cleaned interior.
If the previous lessee fails to return the vehicle on time, the Lessor shall refund a pro-rata rent to the next lessor, or they shall agree on an extension of the rental period, if possible.
Vehicle return:
Upon return, the parties shall record the condition of the vehicle and check the functioning of all devices. Any defects noted shall be recorded and photographed in the takeover report and charged according to the price list. Within 14 (fourteen) working days, the Lessee shall receive in writing a final cost statement to be paid from the rental security deposit.
The vehicle must be collected on the day of rental between 8:00 and 12:00, or by arrangement after 12:00, but no later than 16:00.
In the event of collection between 12:00 and 16:00, the Lessee agrees to pay an additional 50% of the value of the rental day.
The Lessee is obliged to communicate the exact time of collection of the vehicle at least 7 days before the start of the rental period, which must be adhered to by both the Lessee and the Lessor. Changes to the hours or extension of the rental period can be made at a later date, subject to prior arrangement and payment of a 60 EUR administration fee. Should the rental period be extended, the rental day will be charged according to the applicable price list.
In the event of a delay in the return of the vehicle, the Lessee is obliged to notify the Lessor in writing of the estimated time of return and agrees to pay the following:
- 100 EUR for a delay of 1 - 3 hours,
- 300 EUR for a delay of between 3 and 12 hours,
- the full amount of the rental security deposit in the event of a delay of over 12 hours,
- in the event of a delay of more than 24 hours, in addition to the above charges, 250 EUR for each additional day of delay, and reporting the vehicle to the police for theft.
The Lessee acknowledges that smoking is not allowed in the vehicle and that in case of cigarette smell in the vehicle, he/she will be charged a fine of 300 EUR.
The full amount of the rental security deposit shall be refunded to the Lessee no later than within 30 working days after the return of the motorhome, provided that the vehicle is returned on time, undamaged and in good condition, in accordance with these General Terms and Conditions.
7. REPAIRS DURING THE MOTORHOME RENTAL PERIOD
The Lessee undertakes to inform the Lessor without delay of any malfunction by telephone at 0038640462696 or by e-mail at rudolfmoto@gmail.com and to agree with the Lessor on the method of repair at the nearest authorised service centre. The Lessee is not allowed to tamper with the vehicle, neither the motor part nor the interior part, without prior agreement with the Lessor.
The Lessor will not reimburse the Lessee for any repair costs that have not been agreed, coordinated and approved by the Lessor.
In the event of a breakdown of the vehicle, the Lessee is not entitled to reimbursement of any unused part of the rental fee for the time of the repair or for any other vehicle, or to compensation for transport or other costs incurred at the time of the breakdown of the vehicle or the traffic accident.
Any use of the vehicle that contravenes applicable law or the principles of due diligence shall be considered an improper use of the vehicle. In such cases, the Lessee will also be liable for all repair costs.
Tyre damage and air leakage from a damaged tyre are not considered a defect and are the responsibility of the Lessee for repair and any costs incurred.
If, upon return of the vehicle, any part of it or the equipment is found to have been replaced or lost, the Lessee undertakes to pay compensation equal to the price of the new part or equipment.
8. PROHIBITED USE OF A MOTORHOME
The Lessee undertakes not to use the vehicle for any activity not permitted by law.
The use of the motorhome is prohibited for any of the following:
- for regular passenger or freight services,
- in competitions, tests or races,
- for propelling or towing another vehicle,
- when the vehicle is not in running condition or is overloaded,
- when the vehicle is off I, II, III class roads,
- when driving at speeds above the legal limit,
- in case of illegal activities (theft, customs or foreign exchange offences),
- for the transport of dangerous, explosive, flammable, toxic or otherwise hazardous substances,
- for transporting weapons, drugs, etc.,
- for further vehicle rentals,
- for driving in war zones and other threatened areas.
For any breach of these General Terms and Conditions and the Vehicle Hire Contract, the Lessee undertakes to indemnify Rudolf Moto d.o.o. for any damage caused thereby, the amount of which will be determined by Rudolf Moto d.o.o.
9. INSURANCE
The vehicle is compulsorily and Casco insured with a 5% deductible franchise.
10. HANDLING AN ACCIDENT
In the event of any accident (traffic accident, burglary, vandalism, etc.), the Lessee is obliged to immediately report the incident to the nearest police station, regardless of the country of travel, and to immediately inform the Lessor in writing thereof.
In the event of an accident involving two or more vehicles, the Lessor must ensure that the "European Accident Report" form is completed and, together with any police reports, handed over to the Lessor upon return of the vehicle.
If the Lessee fails to comply with any of the above or statutory obligations in the event of a traffic accident or damage event, he/she shall be liable to indemnify the Lessor against any damage resulting therefrom, including insurance premiums, if the insurance company refuses to pay the damage for reasons caused by the Lessee.
When returning the damaged vehicle, the Lessee is obliged to fill in an accident report. The Lessee is required to hand over all the relevant documentation together with pictures clearly showing the damage to the motorhome. The police report must contain the names and details of all the parties involved in the accident, the insurance policy numbers and all the vehicles involved in the accident.
In the event that the Lessee fails to report damage resulting from a traffic accident or any other damage to the vehicle and the insurer refuses to pay for the damage caused by the interruption of the trip, the Lessor shall not be obliged to provide the Lessee with a replacement vehicle. In case of such inconvenience, the Lessee waives any claim.
The Lessee is to bear all costs in the event of:
- a road accident in which the driver of a motorhome was under the influence of alcohol,
- the insurer refuses to pay for damage to the rented vehicle for any reason,
- in the event of a break-in (costs according to the current price list).
The Lessee shall be liable without limitation for damage not resulting from a traffic accident in the event of:
- overload damage (total permissible weight of the vehicle is 3,500 kg),
- transporting illegal substances and persons with irregular or without documents,
- anything not permitted by the law of the Republic of Slovenia and the country in which it is located.
11. LIABILITIES OF THE LESSOR
The Lessor shall ensure that the vehicle is in good technical condition and free from any defect that could cause an accident. The Lessor shall not be held liable for items left or forgotten in the motorhome. In no event shall Rudolf Moto d.o.o. assume any liability for damages in relation to this paragraph.
12. LIABILITIES OF THE LESSEE
The Lessee is obliged to use the motorhome with due care and diligence. The motorhome can only be driven by the Lessee specified in the Contract. He/she must obey the road traffic rules. The Lessee undertakes to pay any charges or penalties that may be brought to the attention of the authorities against the Lessor as owner of the vehicle. The Lessee shall be liable for any damage caused by his/her own fault up to the value of the deductible franchise under the Casco insurance and shall make up for the loss of the bonus in this respect. In the event of damage caused by an unauthorised driver or by an overload, in short, by any unauthorised use, the Lessee shall be held liable without limitation. If the insurer for any reason refuses to cover the loss, the Lessee is obliged to cover the loss himself/herself. He/she is also liable for any damage not resulting from the car accident. The Lessee is obliged to carry his/her documents and keys with him/her at all times when leaving the vehicle, as this is a condition for the theft insurance cover. For breach of this obligation, the Lessee is liable to the Lessor under the general rules on liability for damages. All the vehicles are equipped with all the necessary documents and all are the Lessee's full responsibility.
13. CAMPING AND USE OF MOTORHOMES OUTSIDE CAMPSITES
The Lessee undertakes to comply with the rules of permitted overnight stays or camping outside campsites in each country in which he/she travels. The Lessee shall be liable for all fees, fines and charges related to improper or unauthorised parking or camping and, in the event of any seizure of the motorhome by the authorities, shall reimburse the Lessor for all costs incurred in connection therewith and compensate him for loss of income in the event that such seizure results in a delay in the return of the motorhome to the Lessor.
14. ANIMALS
Animals are not allowed to be transported in the Lessor's vehicles. If the Lessee violates this ban, he/she shall be liable for the costs of the deep and dry cleaning, which amount to 300 EUR.
The Lessor may give the Lessee consent to transport the animals, whose terms and conditions shall be agreed between the parties in the Contract.
15. PERSONAL DATA
The Lessor hereby declares that any personal data obtained from the Lessee or his/her travelling companions for the purpose of concluding this Contract will be carefully stored by the Lessor and used solely for the purpose of the performance of the Rental Contract. The Lessee's personal data may only be disclosed to third parties for the purpose of settling insurance cases, traffic offences or other penalties committed during the rental period.
16. DISPUTE SETTLEMENT
The parties undertake to resolve any disagreements and disputes arising out of this Contract by mutual agreement.
The parties hereby agree that any disputes arising out of this Contract shall be settled on the basis of the provisions of the Contract and these General Terms and Conditions, and where the Contract or the General Terms and Conditions do not regulate the subject matter, the legislation of the Republic of Slovenia shall apply. If the parties are unable to resolve the dispute by mutual agreement, the court in Grosuplje shall have jurisdiction over the dispute.
17. GENERAL PROVISIONS
These General Terms and Conditions are published on the website and are always kept in the vehicle at the time of collection.
