DRIVER
The driver must be aged 25 years old or over and must be in possession of a full driving licence for over three years. Young drivers 21-24 years old must purchase an extra insurance. The driver is responsible, from the date and time of vehicle collection, for any fines or accidents with criminal or legal proceedings. Delivery of the motorhome may be refused if the driver does not present sufficient assurances of capacity. Only drivers indicated in the rental agreement may drive the motorhome.
VEHICLE CONDITION
The motorhome is made available to the Renter at the Rental Company’s premises and its collection implies that the Renter accepts the vehicle delivered and perfectly understands its conditions of use and service. The rental period starts from the moment when the Renter takes legal possession of the motorhome, materialised in the signing of the contract and the delivery of a set of keys. The rental agreement consists of the rental of a vehicle in clean and perfect working order, including a set of accessories. Any comments to the contrary should be made on collection and return of the vehicle. The vehicle must be returned in the same condition as when it was collected. The Renter is responsible for cleaning the motorhome at the end of the rental period; otherwise, an additional of 1,000 dirhams (approx. €90) for valeting will be charged. Similarly, any minor damage or repairs not covered by the insurance policy will be discounted by mutual consent and paid forthwith. Other damage covered by the insurance policy will be appraised, repaired and discounted from the guarantee included in the price. In this case, the guarantee will be cashed in full by the Rental Company, which will return to the Renter the difference between the guarantee and the sum of the damage detected within a period of two months.
VEHICLE DOCUMENTATION
The Renter must keep all vehicle documentation in good condition. In the event of loss, the Renter must make the required statements with a view to issuing a duplicate, replace all documentation at his or her own expense, and pay the Rental Company the sum of a loss of income charge for the motorhome, calculated on the daily rental price from the moment the motorhome was immobilised.
COLLECTION AND RETURN
The point of collection and return must necessarily be at the Rental Company (unless agreed otherwise by both parties), at the meeting point specified and on the date and time indicated in the agreement. The motorhome will be delivered to the customer with full fuel and water tanks and an empty service-water tank. The vehicle must be returned in the same conditions. The level of fuel on vehicle collection will be indicated on the rental agreement. The vehicle must be returned with the same level of fuel.
GUARANTEE
A guarantee of a value of 18,000 dirham (approx. €1,700) must be paid on vehicle collection by credit card. It may be returned on the return of the vehicle after having performed a full inspection of the vehicle and deducting any possible expenses not covered by the insurance policy (minor damage detected together by the Renter and the Rental Company, documented on a vehicle condition report signed by both parties).
CLAIMS
In any case, the Renter should notify us as soon as possible of any claims by telephone. In the event of vehicle theft, a declaration must be made immediately at the police station and the affidavit with the keys and vehicle documentation must be sent to us. In the event of an accident, the Renter must give the corresponding statement and immediately send it to the insurance company. The Renter must not, in any case, abandon the vehicle at the location of the accident without prior authorisation from the Rental Company. It is recalled that, in accordance with the principle of liability for one’s own acts, the Renter is responsible for all infractions committed during the rental period.
INDEMNITY
A delay in delivery or the incorrect operation of the vehicle or its accessories during the rental period may not result in any indemnity whatsoever if the Renter interrupts the vehicle rental at his or her own initiative without having considered the solutions proposed by the central reservations office or if such problems are brought about by the Renter.
FUEL-OIL
The cost of vehicle fuel will be borne by the Renter. The Renter agrees, wherever possible, to fill the vehicle with fuel at the “TOTAL” service stations, which offers a clean, adapted fuel for the vehicles. All checks associated with the good working order of the vehicle are carried out by the Rental Company before each departure. However the Renter is responsible for checking oil, coolant and braking fluid levels, as well as the battery and tyre pressure during the rental period and must perform the appropriate servicing and upgrades at the intervals recommended by the manufacturer (particularly, for long-term hire).
SERVICING
Normal servicing, in other words, normal mechanical wear, shall be borne by the Rental Company. In the event of vehicle immobilisation, repairs may not be performed without our prior written authorisation (telegram or fax) and according to our instructions. Defective parts replaced and the invoices paid must be presented; they will be reimbursed insofar as they do not result from abnormal wear. All serious mechanical trouble must be communicated to us immediately by telephone.
RENTAL PERIOD
The rental period with the dates and times stated is binding. The rental period may not be extended without the agreement of the Rental Company, failing which legal proceedings will be taken for the misappropriation of the vehicle or abuse of trust. After 24 hours’ delay, the motorhome will be considered as stolen and a claim for theft will be filed with the police. In general, no extensions will be allowed; in fact, the vehicle is hired to other people from the day of its return. The possible consequences of a late return shall be borne by defaulting Renter; at least, the defaulting Renter must pay a penalty equal to four times the daily price for every day’s delay, in addition to the standard rental price. Furthermore, a vehicle not returned within the agreed period shall no longer be insured (unless the Rental Company was notified of the delay). In the event of vehicle return before the agreed date, no reimbursement will be made.
SUBLEASE RENTAL
Sublease rental is strictly forbidden; it is not covered by any insurance policy. Only the drivers mentioned in the agreement are authorised to drive the vehicle.
FORCE MAJEURE
In the event of force majeure (accident or otherwise) preventing the vehicle from being delivered on the date and time agreed, the Rental Company may propose another vehicle (subject to availability) to replace the one contracted or may purely and simply reimburse the amounts already paid by the Renter if no vehicle is available. The reimbursement of the rental amount may be performed within 30 days following the date of cancellation. In no way whatsoever will any kind of compensation be paid. The Renter declares to have read and understand this clause during the booking.
PETS
Pets are allowed provided that there is no risk that they may cause damage to the rented vehicle or under specific acceptance of the Rental Company (optional).
GENERAL ADVICE
We ask that you warm up the engine beforehand to prevent any cold starts. Please drive carefully and gently as you would if the vehicle were your own. The Renter must close and lock the vehicle when not in use and keep the keys and documentation with him or her at all times, which in any case should not be left on board without supervision. The Renter must park the motorhome in a safe location at all times. When the vehicle is in motion, the gas bottle should be shut off. If you are driving a vehicle that is longer and higher than your usual car, please bear this in mind when you are parking and going under bridges. We thank you for choosing us and wish you a pleasant journey. For all disputes, the competent courts are those of the Rental Company’s head office.
